Depois do Clarín, a Justiça

Em guerra com o conglomerado de mídia mais importante da Argentina, o governo parecia ter no Clarín seu inimigo número 1. O cenário era este até a semana do fatídico 7D (7 de dezembro), quando caducaria a cautelar obtida pelo grupo na Justiça e este teria de começar o processo de desinvestimento de muitas de suas licenças.

Nos tensos dias que antecederam o 7D, o governo começou a disparar contra o sistema judiciário. O ministro de Justiça, Julio Alak, disse que uma determinação que beneficiasse o Clarín poderia ser interpretada como um “levante”, enquanto o deputado ultrakirchnerista Carlos Kunkel disse que os juízes estavam preparando um “golpe de Estado”.

Foi o suficiente para armar-se um clima pesado entre os magistrados do país e Cristina. Desde então, o panorama foi ficando cada vez mais feio. E é difícil dizer hoje se o verdadeiro inimigo atual do governo é a mídia ou a Justiça.

No dia 6, incomodados com a pressão do governo, os juízes da câmara onde tramitava o caso Clarín concederam ao conglomerado uma prorrogação da cautelar que eximia o grupo de cumprir com dois polêmicos artigos antimonopólio da Lei de Mídia. 

Os kirchneristas ficaram furiosos. Cristina, em discurso na Praça de Maio, falou em “pistolas do judiciário”, e a sugerir que a Justiça deveria “ouvir a vontade popular”, como quem diz que sua autoridade, por conta dos 54% dos votos que recebeu em outubro de 2011, estava acima da lei.

Durante a semana, as provocações continuaram. Cristina voltou a criticar os juízes, dizendo que havia um “divórcio” entre a justiça e a sociedade argentinas e propondo um plano para reformar o sistema, colocando-o mais sob o controle do Estado.

A Corte Suprema, por sua vez, não se intimidou, e disse “não” ao pedido extraordinário de “per saltum” para o recurso sobre a Lei de Mídia.

Outro funcionário kirchnerista foi direto a um juiz da Corte Suprema, Ricardo Lorenzetti, acusando-o de ter pretensões eleitorais, e por isso não possuir crédito. Lorenzetti respondeu duramente, em entrevista a uma rádio, dizendo que a Justiça era independente das corporações e negando sua candidatura.

Na sexta, no final do dia, um juiz de primeira instância declarou constitucional a Lei de Mídia, abrindo um novo capítulo na disputa entre Clarín e governo. Foi uma pequena vitória de Cristina, mas ainda insuficiente para comemorar, uma vez que cabe recurso e a novel continua.

O saldo do mês de dezembro, porém, é de um desgaste muito grande entre Executivo e Judiciário, com o primeiro acuando o segundo. Até onde Cristina levará esse cabo-de-força não se sabe, mas trata-se de mais uma atitude um tanto irresponsável de sua parte. Não existe democracia nem país maduro onde a Justiça não seja independente.
