Desde que começaram as mobilizações, principalmente da classe média, contra o governo Cristina Kirchner, o fantasma que assustava os anti-kirchneristas era o do exemplo venezuelano. A mídia opositora também embarcou na ideia de que, se o autoritarismo de Cristina e suas ações contra a imprensa se agravassem, o país estaria cada vez mais parecido ao parceiro caribenho.

A verdade é que o discurso kirchnerista dá muito espaço para que se pense isso. Controle ao dólar, perseguição à imprensa, expropriações, uso indiscriminado da cadeia nacional, são muitos os pontos em comum entre o kirchnerismo e o chavismo. Se levarmos em consideração que, na Argentina, há um aprofundamento do que os governistas chamam de “modelo”, realmente o vínculo com o país de Hugo Chávez se faz mais evidente.

 Porém, na última semana, a Justiça argentina deu provas de que ainda existe mais institucionalidade aqui do que em países como Equador e Venezuela, onde todos, Congresso, Justiça e outros estão completamente à mercê do poder presidencial.

Após passar a semana ouvindo ataques e pressões por parte de membros do governo, os juízes reagiram. Tinham sido chamados de “revoltosos”, pelo ministro da Justiça, Julio Alak, e até acusados de estarem planejando um “golpe de Estado”, segundo o deputado ultra-kirchnerista Carlos Kunkel.

Isso porque o governo pressionou muito para que se mantivesse para a última sexta-feira, o chamado 7D, o prazo final para que os meios que possuem licenças excedentes segundo a Lei de Mídia, aprovada em 2009, apresentassem um plano de venda de suas concessões.

A Lei já está em vigor, mas havia duas cláusulas a que o Clarín, maior conglomerado do país, se opunha e por conta das quais havia entrado na Justiça.

O governo já planejava o leilão das licenças excedentes do grupo, e também realizar uma grande festa por ter conseguido dar a estocada final em seu principal inimigo desde 2008.

Na quinta à noite, porém, a Justiça colocou água nos planos do governo e prorrogou a cautelar que beneficia o Clarín e outros meios que possuem licenças excedentes. Ficou adiada a aplicação dos polêmicos artigos até que seja julgada a chamada “questão de fundo”, ou seja, a inconstitucionalidade da lei, o que deve acontecer em janeiro.

A trama jurídica, pelo visto, vai durar um tempo. E é justamente isso, tempo, que o Clarín quer. A estratégia do grupo, ao que parece, é esperar que se acirre mais a queda de popularidade de Cristina e o desgaste desse governo. No ano que vem, com as eleições legislativas, este pode perder apoio e até ver ameaçada sua maioria no Congresso. Se for assim, será mais difícil mobilizar os poderes para debilitar o império midiático, e a situação toda pode ficar para o próximo governo.

O “não” dos juízes, porém, é um bom sinal. Não por travar a lei, que deve mais é ser discutida e aplicada, caso seja isso que os argentinos decidam, por meio de seus representantes. A negativa do judiciário mostra, porém, que não é correto que o Executivo exerça pressão sobre o Judiciário, e que este atenda os pedidos do governo passando por cima da Constituição. Um ministro da Justiça que faça ameaças a uma corte é algo inaceitável. E a resposta da Justiça deu bem a conta disso.

O mais importante foi confirmar a independência dos poderes. Isso, mais uma sociedade crítica e complexa, aberta a distintos tipos de discussão, fazem da Argentina um país mais difícil a ser dobrado por semi-ditadores, como infelizmente está acontecendo na Venezuela e no Equador.
