A aproximação do 7D, data em que deixará de ter valor uma medida cautelar obtida pelo Grupo Clarín para evitar que sejam colocados em vigência dois artigos polêmicos da Lei de Meios, abriu uma disputa de propagandas na televisão.

Por um lado está o governo, que produziu um spot e vem alardeando a data como a da democratização dos meios de comunicação na Argentina. A mensagem vem por meio de vídeos, discursos de Cristina e defesa da lei em vários programas de canais ligados ao governo.

A ideia de que o 7D seria um ultimato ao grupo Clarín começou com um duríssimo spot (http://www.youtube.com/watch?NR=1&feature=endscreen&v=JfS942SJSx0). Nele, se anunciava que, nesta data, entrarão em vigência os polêmicos artigos 45 e 161, que se referem à quantidade de licenças e meios que um grupo pode ter e “garante a quantidade de vozes”.

O vídeo explica que a lei, aprovada há três anos, prevê um processo de adequação e que há um órgão, a Afsca, criado para vigiar sua aplicação. “Todos aceitaram a Afsca, menos o Clarín”, reforçam. São expostas as inadequações do grupo, de acordo com a lei: “cada grupo empresário pode controlar até 24 licenças de televisão paga e 10 das denominadas abertas, entre rádios AM, FM ou de TV.

O Clarín tem mais de 240 sistemas de cabo, 9 rádios AM, 1 FM e 4 canais de televisão aberta. “Uma verdadeira cadeia nacional ilegal”, conclui, repetindo palavras que a própria presidente usa para definir o grupo de mídia.

Depois, a acusação mais dura, a de que o Clarín está indo contra as instituições democráticas. “O grupo ignora os três poderes: o Executivo, ao não reconhecer a Afsca, o Legislativo, por não querer cumprir uma lei aprovada pelo Congresso argentino há três anos, e o Judiciário, ao desconhecer decisões da Justiça argentina.” E pergunta-se: “Pode um meio empresário estar por cima das instituições democráticas de um país?”

O vídeo ainda diz que o governo não irá expropriar nem nacionalizar nada, mas que “se verá obrigado a chamar um concurso público”, garantindo as fontes de trabalho e passando as licenças a outros titulares.

A resposta do Clarín tem vindo em alguns spots. O primeiro (http://www.youtube.com/watch?v=S8duNFpRwYs) reforça que no dia 7 de dezembro não deve acontecer nada, pois a cautelar pode ser prorrogada e, se não for, ainda assim o grupo alega que tem pela frente um ano para adequar-se. E sugere que a pressão do 7D, na verdade, busca “preparar o terreno para outra coisa” ou “acabar com o estado de direito na Argentina”.

Num outro vídeo (http://www.youtube.com/watch?v=NaKri9PCVrw), o Clarín elenca e nomeia seus principais jornalistas, para mostrar como são diferentes, mas coincidem “em sua verdade”. Aparecem o apresentador do “Telenoche”, Marcelo Bonelli, o humorista Borensztein, o sisudo Pepe Eliashev, o apresentador Tinelli e a estrela de seu elenco, Jorge Lanata.

“Este é um grupo de jornalistas, artistas, animadores, camarógrafos, maquiadores, gráficos, locutores, fotógrafos, engenheiros, editores. E especialmente um grupo de leitores, telespectadores, ouvintes, internautas. Um grupo que pensa que este é um momento muito especial do país. Um momento onde não há que se ter medo, nem sequer ao medo. Se a liberdade de imprensa está em perigo, que não esteja em perigo a liberdade de pensar.”

Depois, veio mais um (http://www.youtube.com/watch?v=aK9D2RN15Gc) para explicar que o Clarín está cumprindo outros artigos da Lei de Meios, como o que obriga a produção de conteúdos nacionais, a instalação de dispositivos para deficientes auditivos, e que acudir a justiça no caso dos artigos que considera inconstitucionais é democrático.

O último a ir ao ar se chama “ainda se pode escolher” (http://www.youtube.com/watch?v=08RBccvmNEo) e aponta que um jornal só cresce se é comprado, que uma televisão só prospera se tem audiência, assim como uma rádio e a internet. Conclui dizendo que o fato de o grupo ser vigoroso hoje deve-se à demanda por seus produtos, e que essa faz do Clarín algo “nacional e popular”, para usar a expressão com a qual se autodefine o governo.

A poucas semanas da definição dessa novela, o 7D já é esperado como uma final de um campeonato importante, nesse país em que a paixão pela política é futebolística. Para além da guerra jurídica, constituiu-se também uma guerra de imagens e símbolos em que a televisão é uma das protagonistas.

O final dessa novela pode ser a retomada do vigor da gestão kirchnerista ou o início de um desgaste que pode ter consequências nas eleições legislativas do ano que vem. Ou seja, ainda em 2012, a Argentina terá o kirchnerismo diante de uma importante encruzilhada.
